Customer Agreement
Welcome to Parent Concepts.com. This Agreement (the "Agreement") is a legal
agreement between you and Parent Concepts (PC) that states the terms and
conditions under which you use the ParentConcepts.com Web site (the "Site").
Your use of the Site constitutes your agreement to the terms and conditions set
forth below. If you do not agree to these terms and conditions, do not use the
Site or the service.
Notwithstanding any statements on the ParentConcepts.com web pages or elsewhere,
these Terms and Conditions are the agreement between you and PC. By using this
site and reading the tips and advice we provide herein, you confirm that you
have read, understood and agree to these Terms and Conditions.
Communications
PC shall conclusively presume that online communications received from you
through your use of the online payment system is accurate, complete, and
authorized by you as received by PC. You agree not to contest the validity and
binding legal effect of those communications.
Online Payment for Distance Consultations or Downloads (Via Phone or Internet)
You agree to complete the initial registration process according to PC
requirements stated on the Web site, and to provide PC with accurate, complete
and updated information as required for the initial registration process,
including, but not limited to, your legal name, billing address, email address,
and appropriate telephone contact numbers. You must provide PC with an accurate
and complete credit card number and expiration date at the time of payment. You
represent and warrant to PC that your use of any credit card is authorized and
legal.
Shopper Information Changes.
It is your responsibility to promptly notify your bank of any changes to your
billing information or the loss, theft, or unauthorized use of your credit card
number. You are responsible for updating your credit card information as
necessary.
Behaviorist
While the advice we offer is by a Board Certified Behavior Analyst, he is not a
medical doctor. We do not provide medical advice. By entering into this
agreement with us, you acknowledge that we have advised you to seek the advice
of your physician or other health care provider if you have any medical
questions or questions regarding any medical conditions of your child.
Limitation of Liability
PC shall not be liable to you for any interception of
online communications, software or hardware problems (including, without
limitation, viruses, loss of data, or compatibility conflicts), unauthorized use
of your credit card, or other consequences beyond the reasonable control of PC.
Parent Concepts offers practical advice from Daniel Adatto regarding the
behavior patterns of the child(ren) within your family unit. The tips and advice
offered at this site, including, without limitation, any advice on disciplining
your child(ren), is undertaken at your sole discretion. Should you decide to
follow all or any part of the advice provided at this site, or should you
require your child(ren) to follow any instructions provided at this site, you
and they do so entirely at your own risk, and by voluntarily undertaking such
risk, you hereby release Parent Concepts, its agents and employees, from any and
all claims, actions, damages, obligations or liabilities based upon any acts or
omissions in connection with the advice provided herein. We make no promises or
guarantees regarding the outcome of the situation for which you have sought our
advice.
Confidentiality.
PC values you as a customer and your right to privacy. Except as may be
otherwise required by law, PC will exercise commercially reasonable efforts to
ensure that your credit card information remains confidential and is available
only to personnel who have a need to know such information in connection with
providing you with PC Consultation services or otherwise for PC general business
purposes, and will not sell your name, address or similar personally identifying
information to unrelated third parties or permit the use of such information
outside the scope of the PC service or PC general business purposes.
PC Privacy Policy
PC respects the privacy of our clients. We take steps to ensure that your
privacy is respected and protected when collecting and using information you
provide.
Data Collection
PC only collects personally-identifying information when you visit our web site
-- www.parentconcepts.com; and register to receive our newsletter by email or
pay for a consultation that contains personally-identifying information.
"Personally-identifying information" means your name, address, bank account,
credit card number, telephone number, email address or other information by
which you can be personally identified.
In addition, when you order a consultation, we may record data about the
transaction including the time and date the order is placed.
Data Use
PC does not sell or lease personally-identifying information to any other
company, person or agency. PC will disclose personally-identifying information
only if required to do so by law, or if requested to do so by a law enforcement
agency in the context of an ongoing criminal investigation where such disclosure
could be required by subpoena or court order. Any request for information must
be cleared by our Attorneys. In addition, PC may use any information our
customers provide when conducting our own investigations of alleged customer
wrongdoing, such as dishonored or fraudulent method of payment.
Security
We provide protection against unauthorized disclosure of the information you
share with us. We store information in a secure manner. We restrict access to
personally identifying information to only those with a need to know. We also
educate those people with access to customer information about their
responsibility to protect your privacy and we give them clear guidelines
regarding the use and disclosure of such information.
